The Common Council met in a special session at City Hall in the City of Black River Falls on June 17, 2020 at 6:00 P.M. Alderpersons Gearing-Lancaster, Ross, Brown, M. Rave, E. Rave, Olson, and Busse were present. Alderperson Ammann participated via Zoom. Mayor Jay Eddy presided.

It was moved by Alderperson Olson, seconded by Alderperson M. Rave to dispense with the reading of the minutes from the June 2, 2020 Common Council meeting and approve as presented. Motion carried.

CITIZENS IN ATTENDANCE

There were 7 citizens in attendance. Jen Gunning is a representative of the Tavern League of Wisconsin and addressed the Council regarding state statute that allows for the approval of parking lots and of outdoor spaces for establishments applying for liquor licenses. She understood there was question on four properties requesting use of outdoor spaces and that the City Attorney stated he would have to look in to Chapter 125. The City Administrator clarified that at the last meeting, the City Attorney requested time to review the statute and city ordinances and he did that and the licenses were approved later in the meeting. The City Attorney had advised at that time that state statute did not prohibit the use of outdoor space, but a city ordinance did prohibit open intoxicants in public parking lots. The article in last week’s local newspaper was not accurate and a correction was printed this week.

It was moved by Alderperson M. Rave, seconded by Alderperson Gearing-Lancaster to accept the Public Safety Planning Task Force’s recommendation to terminate the public safety building project as presented in the minutes. Motion carried.

It was moved by Alderperson Olson, seconded by Alderperson Busse to approve the application for a Class B Beer & Class B Liquor Retail License for Rosy Cantina, LLC located at 43 Main Street for the period June 17, 2020 through June 30, 2020. Motion carried.

Kim Shult and Nick Goeman from Baker Tilly presented a summary of the 2019 audit via Zoom meetings.

It was moved by Alderperson Busse, seconded by Alderperson Ross to approve Amendment #5 to the Employee Handbook, Section VI – Hours & Pay, Inclement Weather. Motion carried

DEPARTMENT REPORTS

It was moved by Alderperson Busse, seconded by Alderperson Olson to approve the Request for Bids to remodel the 40’ x 60’ cold storage building located at W9875 Airport Road. Motion carried.

It was moved by Alderperson M. Rave, seconded by Alderperson Ross to approve the purchase and installation of a new server at City Hall with cost not to exceed $14,925.00. Motion carried.

Mayor Eddy introduced Jody Stoker as the new Fire Chief.

It was moved by Alderperson Ross, seconded by Alderperson Gearing-Lancaster to approve the Fire Department’s request to sell a 1974 Ford Pumper and a 1997 Kawasaki Mule. Motion carried.

The Street Superintendent discussed the ongoing problem with brush. Several residents are having contractors cut trees down and plan to clean the trees up themselves which could lead to Street Dept staff working on brush instead of other projects that can only be performed during the summer such as sidewalks, curb, and gutter. Brush pick up requires a lot of man power. There was consensus to have the Street Superintendent, City Attorney, and City Administrator work on an ordinance or resolution to create or modify the city’s policy for brush pickup. The 8th Street culvert should be televised this week and cost of repair could be as much as $6,000 which is not budgeted.

The Chief of Police advised the Council of a peaceful demonstration that took place on June 6th. The Police Dept worked closely with the Sheriff’s Dept on this event. Alderperson Gearing-Lancaster suggested a Chief’s Notes section be added to the monthly report where the Chief would give his perspective on general law enforcement policies and current events.

The Parks & Recreation Director updated the Council on various events that have been cancelled at the fairgrounds. As of now, the Jackson County Fair has not been canceled, but activities have been modified.

There was discussion on a request from Gary Hansen to purchase land from the City on Buchanan Street. The City Administrator will work with the Street Dept. and municipal utilities to confirm there are no underground infrastructure conflicts in this area and work with Mr. Hansen on an estimated purchase price and estimated real estate taxes on the requested land purchase. Mr. Hansen stated he understood the cost for a Certified Survey Map would be his responsibility and stated he received an estimate of between $2,800 and $3,200.

It was moved by Alderperson M. Rave, seconded by Alderperson Olson to move forward with the sale of property to Gary Hansen with the Certified Survey Map cost to be covered by Mr. Hansen. Motion carried (6-2) with Alderpersons Ross and Busse voting no.

It was moved by Alderperson Ross, seconded by Alderperson M. Rave to table the request from Nicole & Matt Mueller for a refund for a claim of excessive assessment until July in order to allow time to gather further information from the assessor and the City Attorney. Motion carried.

There were no updates to the city and department responses to COVID-19.

It was moved by Alderperson M. Rave, seconded by Alderperson Ross to approve the vouchers for May 2020 check #67023 - #67186 totaling $538,177.12 Motion carried.
