The Common Council met at City Hall in the City of Black River Falls on October 2, 2018 at 6:00 P.M. Alderpersons J. Rave, M. Rave, Olson, Busse, Gearing-Lancaster, Redbird, and Brown were present. Alderperson Ross was excused. Mayor J. Eddy presided.

It was moved by Alderperson J. Rave, seconded by Alderperson M. Rave to dispense with the reading of the minutes of the September 19, 2018 Special Common Council meeting and approve as presented. Motion carried.

The Committee of the Whole met at City Hall in the City of Black River Falls on September 19, 2018 at 6:00 P.M. Alderpersons J.
Rave, M. Rave, Olson, Busse, Gearing-Lancaster, Ross, Redbird, and Brown were present. Mayor Jay Eddy presided.

  1. There were no citizens in attendance.
  2. The City Administrator presented the preliminary 2019 proposed city budget, capital budget, and EMS budget.
  3. The Department Head monthly reports were reviewed. Department heads present were Todd Gomer, Steve Peterson, Tammy Peasley, Steve Schreiber, Jody Stoker, Kelly Bakken and Brad Chown.
  4. The City Administrator advised the council the assignment agreement with Waumandee State Bank was signed and payment was received. As a result, the remaining debt on the Rye Bluff Development will be paid off this Friday, September 21, 2018.
  5. Library Director Tammy Peasley presented results from recent library surveys and how they are using the information to improve operations.
  6. Fire Chief Steve Schreiber thanked the Police Department, the Street Department, citizens, and the community as a whole for helping with the funeral services for firefighter Alec Muth.
  7. Street Superintendent Todd Gomer presented two estimates from Gaier Construction. One estimate in the amount of $42,872.00 to build a post frame lean-to addition on an existing storage building to allow for indoor storage of vehicles and equipment, and one estimate in the amount of $7,700.00 for two new service doors for the city shop building.
  8. Police Chief Kelly Bakken provided corrected totals for the officer activity data in her monthly report. The Chief also reiterated the department is shorting itself by not having an investigator position. The Chief has also met with the school district on a school resource officer but they have not made a decision.
  9. Parks & Recreation Director Steve Peterson informed the Committee that he has been working with the county on the runoff issues in the area by the community garden and the FFA plot. They are getting cost estimates together now.
  10. It was moved by Alderperson Olson, seconded by Alderperson Ross to recommend forwarding an ordinance to increase the compensation for Council Members to the Common Council to discuss and consider taking action. Motion carried.
  11. It was moved by Alderperson Ross, seconded by Alderperson Gearing-Lancaster to approve vouchers for August 2018 check #64449 to #64617 totaling $758,765.98. Motion carried.
  12. It was moved by Alderperson Olson, seconded by Alderperson Gearing-Lancaster to approve the City Treasurer’s Report for August 2018. Motion carried.
  13. It was moved by Alderperson Ross, seconded by Alderperson Brown to approve the Revenue & Expense Reports for August 2018. Motion carried.

There was discussion on Ordinance 844 which included concerns with meeting other budgetary needs, time spent attending committee meetings, some committees compensate members and others do not, and the time needed to invest for these positions.

It was moved by Alderperson Olson, seconded by Alderperson Brown to approve ORDINANCE 844 – an ordinance creating section 2.06 to set the compensation for Mayor and City Council members. Motion carried (5-2) with Alderpersons M. Rave and Busse voting no.

CITY OF BLACK RIVER FALLS, JACKSON COUNTY, WISCONSIN ORDINANCE NO.844 AN ORDINANCE CREATING SECTION 2.06 TO SET THE COMPENSATION FOR MAYOR AND CITY COUNCIL MEMBERS.
THE COMMON COUNCIL OF THE CITY OF BLACK RIVER FALLS, JACKSON COUNTY, WISCONSIN, DOES ORDAIN AS FOLLOWS:
SECTION I. Creation of Section 2.06 of the Code of Ordinances. Section 2.06 of the Ordinances of the City of Black River Falls, Jackson County, Wisconsin, is hereby created to read as follows:
2.06 Salaries of mayor and city council.

  1. The salary of the mayor shall be seven hundred dollars ($700.00) per month commencing with the mayor whose term begins on or after the November 6, 2018 election, upon his or her taking and filing the oath required by Wis. Stat. 62.09(4).
  2. The salaries of the members of the city council shall be as follows:
  1. A council member shall be paid one hundred dollars ($100.00) for each common council meeting held each year. A council member will not be so compensated for such meetings that they do not attend in excess of one (1) per calendar year.
  2. A council member shall be paid one hundred dollars ($100.00) for each committee of the whole meeting held each year. A council member will not be so compensated for such meetings that they do not attend in excess of one (1) per calendar year.
  3. A council member shall be paid one hundred dollars ($100.00) for each special meeting held to which they attend. The above-referenced salaries for city council members shall commence with those council members whose terms begin on or after the third Tuesday in April, 2019, and with those council members whose terms begin on or after the third Tuesday in April, 2020, upon his or her taking and filing the oath required by Wis. Stat. 62.09(4).
    C. Conflicting Ordinances: Ordinances or parts of ordinances in direct conflict with this ordinance are hereby repealed.
    D. Effective Date: This ordinance shall take effect and be enforced upon passage and publication as provided by law.

    It was moved by Alderperson M. Rave, seconded by Alderperson Olson to approve RESOLUTION 2018-10 – introduction of resolution regarding the discontinuance of the unpaved alley that lies between Rose Street and Franklin Street. Motion carried. (6-0-1) with Alderperson Busse abstaining.

    CITY OF BLACK RIVER FALLS RESOLUTION 2018-10 INTRODUCTION OF RESOLUTION REGARDING THE DISCONTINUANCE OF PUBLIC WAYS
    WHEREAS, the Common Council of the City of Black River Falls in Jackson County, Wisconsin, based on the Petition of more than 50% of the owners of land abutting a certain unpaved alley, hereby introduces a resolution pursuant to Wis. Stat § 66.1003(3), to discontinue a certain unpaved alley originally laid out in the Plat of Rozmenoski’s Subdivision in the City of Black River Falls, as more particularly described below; and
    WHEREAS, the unpaved alley proposed for discontinuance exists by virtue of a dedicated plat recorded with the Register of Deeds office for Jackson County; and
    WHEREAS, the final resolution shall contain the following language: “The Common Council of the City of Black River Falls, Jackson County, Wisconsin, by this resolution, adopted by a majority of the Common Council on a roll call vote with a quorum present and voting and proper notice having been given, resolves, and declares as follows:
    The unpaved alley contained in the parcel described below is hereby vacated and discontinued under s. 66.1003 (3), Wis. Stats. It is in the public interest that said unpaved alley described below is vacated and discontinued under s. 66.1003 (3), Wis. Stats. The unpaved alley to be discontinued are described as follows:

The entire 16 foot wide alley marked as “ALLEY” and which runs north and south and lies between “ROSE STREET” and “FRANKLIN STREET” on the Plat of Rozmenoski’s Subdivision which is attached hereto.
The discontinuance of the above-described unpaved alley will not result in a landlocked property and no owner of property abutting the discontinued unpaved alley will be damaged by the discontinuance. The discontinued unpaved alley will be vacated and the land awarded to the following owner or owners of real estate abutting the discontinued ways:
(i) Joel and Peggie Busse
(ii) Jody Elmore
(iii) Corey Paar and Genell Johnson
(iv) Jeffrey Mickelson and Craig Mickelson
(v) John and Jeanne Schick
(vi) Patricia Buske
(vii) Steve Firkins and Amy Willette
(viii) Mark and Lara Mueller
The City Clerk shall properly post or publish this resolution as required under s. 62.11, Wis. Stats.”; and WHEREAS, a scale map of the lands that would be affected by the proposed discontinuances are attached hereto, marked as Exhibit “A” and made a part hereof;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF BLACK RIVER FALLS, JACKSON COUNTY, WISCONSIN, AS FOLLOWS:

  1. That a public hearing shall be held at the City Hall for the City of Black River Falls to determine whether discontinuing the above-described streets is in the public interest. Said meeting shall be held not less than 40 days after this resolution is introduced.
  2. That notices of said public hearing required under Wis. Stat. § 66.1003(4)(b) shall be sent. At least 30 days prior to the hearing, said notices shall be served upon all owners of all lots fronting any of the roads proposed for discontinuance and a notice will be published as a class 3 notice under ch. 985. Any objection to the discontinuance by any owner must be made in writing and submitted to the City Clerk for the City of Black River Falls.
