A special meeting of the Common Council was held at City Hall in the City of Black River Falls on November 20, 2008 at 6:00 P.M. Alderpersons Austin, Onstad, Johnson, Mathews, R. Eddy, Rahmlow and J. Eddy were present. Alderperson Olson was absent. Mayor Danielson presided.

Mayor Danielson opened the public hearing on the proposed 2009 City of Black River Falls budget.

There was no one in attendance to speak at the public hearing.

It was moved by Alderperson Austin, seconded by Alderperson J. Eddy to close the public hearing as above. Motion carried.

Mayor Danielson reviewed a handout of estimated Fair Park costs and contributions/pledges received to date. Costs exceed contributions/pledges by $434,000. The Mayor stated the various Fair Park Committees have agreed to about $100,000 in cost reductions. Further, the Lunda Charitable Trust has agreed to match future contributions dollar for dollar. The Mayor feels that a county-wide fundraiser will be able to raise at least the $170,000 to be matched by the Lunda Trust to completely fund the project.

It was moved by Alderperson R. Eddy, seconded by Alderperson Onstad to award the bids as opened previously for the ice arena, grand stand, four barns, site work and parking lot and to authorize the City to borrow the funds necessary to cover the 5 year pledges to complete the project. Motion carried.

It was moved by Alderperson Mathews, seconded by Alderperson Rahmlow to approve the 2009 proposed rate increase for the Black River Emergency Medical Service. The detail is available at City Hall. Motion carried with Alderperson J. Eddy abstaining.

It was moved by Alderperson Mathews, seconded by Alderperson Onstad to approve the City Administrator employment agreement effective May 1, 2009 as amended. Motion carried with Alderperson R. Eddy voting no.

CITY OF BLACK RIVER FALLS ORDINANCE NO. 786
AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BLACK RIVER FALLS, REPEALING AND RECREATING SECTION 2.05 OF THE CODE OF ORDINANCES
OF THE CITY OF BLACK RIVER FALLS
The Common Council of the City of Black River Falls, Jackson County, Wisconsin do ordain as follows:
SECTION 1. Section 2.05 of the Code of Ordinances of the City of Black River Falls is repealed and recreated to read as follows:
SECTION 2. Committees.
(1) COMMITTEE OF THE WHOLE. The entire Common Council shall constitute the Committee of the Whole. The Committee of the Whole shall meet monthly to discuss all matters, which are to come before the Common Council and to make recommendations to the Common Council.
(2) SPECIAL COMMITTEES. The Mayor may, from time to time, appoint such special committees as he may deem advisable or as the object thereof to perform such duties as may be assigned to them.
(3) RULES OF THE COMMITTEE OF THE WHOLE.
(a)All bills and other financial claims against the City shall be itemized and, upon receipt thereof, shall be examined by and referred by the City Clerk to the Committee of the Whole, provided that payment of regular wages and salaries of officials and employees according to schedules adopted by the Council shall be made by the Clerk without submissions to the Council or Committee of the Whole after approval and verification by the Mayor.
(b) The Committee of the Whole shall, at the next regular meeting, submit a written report on all matters referred to it unless a longer time be granted by vote of the Council and such report be entered in the proceedings. Such report shall recommend a definite action by the Council on each item and shall be filed with the City Clerk prior to each meeting. Minority reports may be submitted.
(c)Previous notice of each Committee of the Whole meeting shall be filed with the City Clerk by the Chairperson and each meeting shall be noticed to the official newspaper at least 24 hours prior to the meeting, and each meeting shall be open to the public in accordance with the open meeting law.
(d) In addition to the right of the Chairperson of a committee to call a meeting, a majority of the committee may call a meeting by giving written notice to the City Clerk.
(e) The Committee of the Whole may require any City official to confer with it and supply information needed in connection with any matter pending before the committee.
(f) Each Committee of the Whole meeting shall be held at the City Hall.
(g) An aye and nay vote shall be taken on each Committee of the Whole report immediately following its submission, provided that any Alderperson may require a separate vote on any ordinance, resolution or other matter in any report. Action upon a specific matter included in any committee report shall be deferred until the next regular meeting following the submission of the report upon the request of any two (2) Alderpersons.
(h) The approval of a Committee of the Whole report in which the adoption of an ordinance or resolution is recommended shall not constitute final action on such ordinance or resolution. Any ordinance recommended for adoption shall have had one full reading before the Council at a meeting of the Council unless an action on an ordinance shall be taken pursuant to a motion temporarily suspending the rules. The approval of a committee report recommending action on a matter other than an ordinance or resolution shall constitute final action on that matter.
SECTION 3. Effect on Other Ordinances. All other ordinances which assign responsibilities, actions, duties or procedures for the Finance Committee, Public Works Committee, Public Safety Committee or Recreation and Development Committee shall be deemed to refer to the Committee of the Whole.
SECTION 4. Severability. The provisions of this Ordinance shall be deemed severable and it is expressly declared that the Common Council would have passed the other provisions of this Ordinance irrespective of whether or not one or more provisions may be declared invalid and if any provisions of this Ordinance of the application thereof to any person or circumstances is held invalid, the remainder of this Ordinance and the application of such provisions to other persons or circumstances shall not be affected thereby.
SECTION 5. Conflicting ordinances. Ordinances or parts of ordinances in conflict with the above Ordinance are hereby repealed.
SECTION 6. Effective date. Upon passage and publication, this Ordinance shall take effect and be in force as provided by law.

Ordinance #787, AN ORDINANCE FOR ANNEXATION OF PROPERTY FROM THE TOWN OF ADAMS TO THE CITY OF BLACK RIVER FALLS, JACKSON COUNTY, WISCONSIN, BY CITY COUNCIL RESOLUTION PURSUANT TO THE PROVISIONS OF WISCONSIN STATUTE SECTION 66.0217(2) was distributed as the 1st reading.

Todd Gomer, City Street Superintendent, presented bids for purchase of a pick-up truck and loader.

It was moved by Alderperson Mathews, seconded by Alderperson Rahmlow to purchase the pick-up from Gross Motors at their low bid of $16,778.00. Motion carried.

The bids for purchase of a new loader were reviewed.

Mr. Gomer recommended that the City not purchase the New Holland loader which was the low bid of $89,051.94 because it would not be in the best interest of the City during the expected 10-year life of the loader. He recommended purchase of a Case loader from St. Joseph Equipment at a cost of $105,800 with trade of the City’s current loader. Representatives of Swiderski Equipment, Inc. in Thorp, WI who sell the New Holland loader were in attendance. They feel the New Holland meets the City specification and stated it is virtually the same as the Case loader referred to above.

It was moved by Alderperson Onstad, seconded by Alderperson Johnson to purchase the Case loader from St. Joseph Equipment as above. Motion carried with Alderpersons Mathews, R. Eddy and J. Eddy voting no.

It was moved by Alderperson Rahmlow, seconded by Alderperson R. Eddy to set the City Attorney salary at $42,000 annually for the 2009/2010 term beginning May 1, 2009. Motion carried.

It was moved by Alderperson Rahmlow, seconded by Alderperson Austin to set the City tax levy at $1,574,796. Motion carried.

It was moved by Alderperson J. Eddy, seconded by Alderperson Mathews to convene into closed session for the purpose of considering employment, promotion, compensation or performance evaluation of City employees which is authorized under Section 19.85(1)(c) of the Wisconsin Statutes. Motion carried.
