Plan Commission Minutes of March 26, 2008 Print E-mail

The Plan Commission met at City Hall in the City of Black River Falls on March 26, 2008 at 6:30 P.M.  Commissioners Johnson, Boisen, Evenson, Tamminen and Moe were present.  Commissioner Bjerke was absent.  Mayor Joseph Hunter presided.

 

1. Chairperson Hunter opened the adjourned public hearing from January 30, 2008 concerning the request for a conditional use permit to allow a wireless tower to be constructed near the intersection of North 4th Street and Harrison Street.

 

2. Sheriff Duane Waldera and Emergency Government Director John Ross explained the current communication system within Jackson County.  Several alternatives were discussed which would not require a tower.  The County representatives, after research with many advisors, recommended the tower as their solution.  

 

3. Local citizen Bob Prillwitz advised the County to wait until new standards are released for new requirements by 2012.  At that time the system should be re-evaluated and updated.

 

4.Several residents spoke against the construction of a tower mainly for aesthetic reasons.

 

5.It was moved by Commissioner Boisen, seconded by Commissioner Moe to deny the request for the conditional use permit for the wireless tower as published.  Motion carried with commissioners Evenson and Tamminen voting against the denial.

 

6. Mayor Hunter opened the public hearing concerning the appeal from the denial of the conditional use permit request by Lutheran Social Services to allow a multi-family dwelling of 8 units on Alder Street north of County Highway A as published.

 

7.Ted Hakala, Vice-President of Lutheran Social Services, reviewed his request for appeal from the denial as above.  The commission also received copies of an appeal letter from John P. Yentz, an attorney with the Schroeder Group representing Lutheran Social Services.

 

8.City Attorney Dan Diehn reviewed the standards which the Commission should use to make the conditional use permit decision.

 

9. All persons in attendance were given an opportunity to speak.

 

10.  It was moved by Commissioner Boisen, seconded by Commissioner Moe to deny the Lutheran Social Services request for a conditional use permit based on the following factors:

 

1. Combining two lots which could each have a four-unit dwelling into one lot with an eight unit dwelling would eliminate the side yard setback resulting in a higher density.

 

2. The requested use is inconsistent with the Zoning Code as it would require at least two (2) variances.

 

3. The requested use is not consistent with other uses in the neighborhood.

 

4. The requested use would not increase the City’s tax revenue.

 

5. The requested use is objectionable to neighbors.

 

11. Motion carried with Commissioners Johnson and Tamminen voting against the denial.

 

12. It was moved by Commissioner Evenson, seconded by Commissioner Tamminen to recommend the property east of the City’s Industrial Park recently annexed from the town of Brockway be zoned I – Industrial.  Motion carried.

 

13. It was moved by Commissioner Evenson, seconded by Commissioner Boisen to adjourn.  Motion carried.
