These minutes to be approved at City Council on January 6, 2009.
The Plan Commission met at City Hall in the City of Black River Falls on December 18, 2008 at 6:30 P.M. Commissioners Johnson, Helland, Boisen, Moe and Mayor Danielson were present. Commissioners Tamminen and Evenson were absent.
1. Mayor Danielson opened the public hearing regarding the petition of VFW Post 1959/ Chad Pooler to obtain a Conditional Use Permit to operate a church on the property at 40 North Roosevelt Road as published. Pastor Chad Pooler presented letters of non-objection from the 3 adjoining property owners. The church will direct that all parking for their activities will be on the east side of North Roosevelt where there are no residences.
2. It was moved by Commissioner Moe, seconded by Commissioner Boisen to grant Chad Pooler a Conditional Use Permit to operate a church at 40 North Roosevelt Road as above. Motion carried
3. Mayor Danielson opened the public hearing regarding the petition of the Black River Falls Area Foundation/Black River Falls Municipal Utility to rezone from RD (Rural Development) to B-5 (Shopping Mall District) Lot 2 of Jackson County CSM 3332 as published. Municipal Utility Administrator Jerry Ewert reviewed the proposed site plan which includes access from North Eighth Street. There was considerable discussion concerning the safety issues of the access road and the utility will make the access as safe as possible for them and their customers.
City Attorney Dan Diehn explained the Utility would still need a Conditional Use Permit for their portion of the development. Commercial businesses could operate on the portion not needed for utility purposes.
4. It was moved by Commissioner Helland, seconded by Commissioner Boisen to recommend the property as above be rezoned from RD to B-5. Motion carried.
5. It was moved by Commissioner Helland, seconded by Commissioner Johnson to accept Lot 2 of Jackson County CSM 3348 donated to the City from the Black River Falls Area Foundation. Future use of the parcel may include softball and soccer fields as well as an area for community gardens. The organizations using the property will have to fund any improvements to the property. Motion carried.
6.The Commissioners reviewed the layout and design of the proposed Fair Park.
7. It was moved by Commissioner Johnson, seconded by Commissioner Moe to approve the layout and design of the Fair Park and buildings as presented. Motion carried.
8. It was moved by Commissioner Helland, seconded by Commissioner Johnson to adjourn. Motion carried.
