Common Council Minutes of September 2, 2008 Print E-mail

The regular meeting of the Common Council was held at City Hall in the City of Black River Falls on September 2, 2008 at 7:00 P.M.  Alderpersons Austin, Onstad, Johnson, Mathews, R. Eddy, Rahmlow, Olson and J. Eddy were present.  Mayor Danielson presided.

It was moved by Alderperson R. Eddy, seconded by Alderperson J. Eddy to dispense with the reading of the minutes of the August 5, 2008 Council meeting.  Motion carried.

Mayor Danielson opened the public hearing as required by the Community Development Block Grant (CDBG) program to inform the public about the CDBG grant application requesting funding for street, storm and sanitary sewer and water system improvements on McKinley Street and D&S Drive in the City. The Council was informed that D&S Manufacturing, Inc. is planning an approximate $7 million expansion which will result in the creation of 36 new full-time jobs. D&S Manufacturing, Inc. is cooperating with the City by agreeing to hire low and moderate income eligible employees for a least 51% of the newly created jobs.

 

All members of the City Council and citizens in attendance were requested to ask questions and comment on the proposed grant application. All comments were extremely favorable to proceed with the project.

CITIZENS IN ATTENDANCE

 

Bob Sloan, DNR Environmental Enforcement Specialist, reviewed the history of the “Pines” demolition situation. The Notice of Violation and Enforcement Conference Summary are both available at City Hall.

It was moved by Alderperson Mathews, seconded by Alderperson Johnson to order the City’s Building Inspector to send a written notice of defect to the owner of the “Pines” property ordering the clean-up. This is a several steps process under the Public Nuisance Statute 66.0413(2) which will be expedited by the City in any way possible. Motion carried.

COMMITTEE REPORTS

 

It was moved by Alderperson Rahmlow, seconded by Alderperson Olson to approve the Finance Committee report of September 2, 2008. Motion carried.

The Finance Committee met at City Hall in the City of Black River Falls on September 2, 2008 at 6:00 P.M.  Alderpersons R. Eddy, Austin, Onstad, Rahmlow and Olson were present.

 

  1. It was moved by Alderperson Rahmlow, seconded by Alderperson Olson to approve the August 2008 general fund vouchers in the amount of $303,895.87. Motion carried.

 

  1. It was moved by Alderperson Austin, seconded by Alderperson Onstad to approve the July 2008 City Treasurer’s report. Motion carried.

 

  1. It was moved by Alderperson Rahmlow, seconded by Alderperson Olson to approve the July 2008 revenues report.  Motion carried.

 

  1. It was moved by Alderperson Onstad, seconded by Alderperson Austin to approve the July 2008 expense report. Motion carried.

 

  1. The City’s preliminary census estimate for January 1, 2008 is 3,583.

 

  1. It was moved by Alderperson Austin, seconded by Alderperson Olson to approve the 2009 and 2010 maintenance contract with Bowmar Appraisal, Inc., the City’s assessors, at an annual cost of $11,200 and $11,500 respectively. Motion carried.

AN ORDINANCE AMENDING THE PROVISIONS OF SECTION NO. 9.26 OF THE CODE

OF ORDINANCES OF THE CITY OF BLACK RIVER FALLS, JACKSON COUNTY,

WISCONSIN, BY REPEALING SECTIONS 9.26(7) AND 9.26(8)

 

The Common Council of the City of Black River Falls, Jackson County, Wisconsin do ordain as follows:

SECTION 1.  Sections 9.26(7) and 9.26(8) of the Code of Ordinances of the City of Black River Falls are hereby repealed.

 

SECTION 2.  Severability. The provisions of this Ordinance shall be deemed severable and it is expressly declared that the Common Council would have passed the other provisions of this Ordinance irrespective of whether or not one or more provisions may be declared invalid and if any provisions of this Ordinance of the application thereof to any person or circumstances is held invalid, the remainder of this Ordinance and the application of such provisions to other persons or circumstances shall not be affected thereby.

 

SECTION 3.  Conflicting ordinances. Ordinances or parts of ordinances in conflict with the above Ordinance are hereby repealed.

 

SECTION 4.  Effective date. Upon passage and publication, this Ordinance shall take effect and be in force as provided by law.

CITY OF BLACK RIVER FALLS ORDINANCE NO.  783

 

AN ORDINANCE REPEALING AND RECREATING THE PROVISIONS OF SECTION NO. 7.06 OF THE CODE OF ORDINANCES OF THE CITY OF BLACK RIVER FALLS, JACKSON COUNTY,

 WISCONSIN, REGULATING WINTER OVERNIGHT PARKING

 

The Common Council of the City of Black River Falls, Jackson County, Wisconsin do ordain as follows:

 

SECTION 1.  Section Number 7.06(6) of the Code of Ordinances of the City of Black River Falls is repealed and recreated as follows:

 

(6)  WINTER NIGHT PARKING REGULATIONS.  When Signs have been erected in accordance with the provisions of Section 349.13 of the Wisconsin Statutes, the following regulations shall be in effect within the corporate limits of the City of Black River Falls, Jackson County, Wisconsin.

 

(a)                      WINTER NIGHT PARKING ALTERNATE SIDES OF THE STREET.  Between the hours of 10:00 p.m. and 6:00 a.m. the following day, vehicles shall be parked only on even numbered sides of the street on those nights having an even calendar date, and on odd numbered sides of the street on those nights with an odd calendar date, except where parking is normally permitted only on one side of the street, vehicles may be parked on that permitted side every night.  These regulations shall be in effect beginning 12:01 a.m., December 1 through 12:01 a.m., April 1.

(b)                     For the purposes of this Section, whether a date is even or odd shall be determined by the Calendar Date at 10:00 p.m..

(c)                      This ordinance shall not be construed to allow parking in any location where parking is otherwise prohibited by sign, ordinance or state statute.

 

SECTION 2.  Severability.  The provisions of this Ordinance shall be deemed severable and it is expressly declared that the Common Council would have passed the other provisions of this Ordinance irrespective of whether or not one or more provisions may be declared invalid and if any provisions of this Ordinance or the application thereof to any person or circumstances is held invalid, the remainder of this Ordinance and the application of such provisions to other persons or circumstances shall not be affected thereby.

 

SECTION 3.  Conflicting Ordinances.  Ordinances or parts of ordinances in conflict with the above Ordinance are hereby repealed.

CITY OF BLACK RIVER FALLS ORDINANCE NO. 784

 

AN ORDINANCE AMENDING THE CHARTER ORDINANCE OF THE CODE
OF ORDINANCES OF THE CITY OF BLACK RIVER FALLS,

REPEALING AND RECREATING SECTION 1.04(2) AND 1.04(4) OF THE CODE OF ORDINANCES OF THE CITY OF BLACK RIVER FALLS

           

            The Common Council of the City of Black River Falls, Jackson County, Wisconsin do ordain as follows:

SECTION 1.  Section 1.04(2) of the Code of Ordinances of the City of Black River Falls is repealed and recreated to read as follows:

 

(2)    POWERS AND DUTIES OF CITY OFFICIALS. City officials mandated under Section 62.09, Wis. Statutes,
shall have the powers and duties prescribed by law and, except for the Mayor, shall perform such duties as shall be requires of them by the Council.  Other City officials shall perform the duties prescribed them by the Council.  The City Administrator shall perform all duties, and shall be subject to the position description approved by the Council.

 

SECTION 2.  Section 1.04(4) of the Code of Ordinances of the City of Black River Falls is repealed and recreated to read as follows: 

 

(4) REMOVAL FROM OFFICE.  All City officials, except the Police Chief and City Administrator, may be removed from office for cause by a majority of the members-elect of the Council.  The City Administrator may be removed from office for cause by a three-fourths vote of the members-elect of the Council.

 

SECTION 3.  Severability.  The provisions of this Ordinance shall be deemed severable and it is expressly declared that the Common Council would have passed the other provisions of this Ordinance irrespective of whether or not one or more provisions may be declared invalid and if any provisions of this Ordinance of the application thereof to any person or circumstances is held invalid, the remainder of this Ordinance and the application of such provisions to other persons or circumstances shall not be affected thereby.

 

SECTION 4.  Conflicting ordinances.  Ordinances or parts of ordinances in conflict with the above Ordinance are hereby repealed.

                SECTION 5.  Effective date.  Upon passage and publication, this Ordinance shall take effect and be in force as provided by law.

AN ORDINANCE AMENDING THE CHARTER ORDINANCE OF THE CODE OF ORDINANCES

 OF THE CITY OF BLACK RIVER FALLS BY REPEALING AND RECREATING SEC. 1.02 AND 1.03 OF THE CODE OF ORDINANCES OF THE CITY OF BLACK RIVER FALLS

 

            The Common Council of the City of Black River Falls, Jackson County, Wisconsin do ordain as follows:

SECTION 1.  Sections 1.02 and 1.03 of the Code of Ordinances of the City of Black River Falls are repealed and read as follows:

 

1.02   ELECTED OFFICIALS.  (1) MAYOR.  The Mayor shall be elected in even-numbered years for a term of 2 years.

 

(2) ALDERPERSONS.  The Council shall consist of 8 Alderpersons elected for 2 year terms.  One Alderperson shall be elected annually from each of the 4 aldermanic districts.

 

(3) CITY ATTORNEY.  The City Attorney shall be elected in odd-numbered years for a term of 2 years.
