The regular meeting of the Common Council was held at City Hall in the City of Black River Falls on March 4, 2008 at 7:00 P.M. Alderpersons Danielson, Olson, Austin, Johnson, Mathews, Eddy and Rahmlow were present. Alderperson Onstad was absent. Mayor Hunter presided.

It was moved by Alderperson Danielson, seconded by Alderperson Johnson to dispense with the reading of the minutes of the February 5, 2008 Council meeting. Motion carried.

Alderperson Danielson introduced recently hired Librarian Muriel Gunderson to the Council.

COMMITTEE REPORTS
It was moved by Alderperson Mathews, seconded by Alderperson Rahmlow to approve the Public Safety Committee report of February 20, 2008. Motion carried.

The Public Safety Committee met at City Hall in the City of Black River Falls on February 20, 2008 at 6:00 P.M. Alderpersons Mathews, Rahmlow, Johnson, Olson and Mayor Hunter were present. Alderperson Onstad was absent.
1. Fire Chief Steve Schreiber presented two bids for the re-roofing of the 1982 Fire Department and 1995 EMS addition. The low bid of $16,000.00 was received from Quality Roofing, Inc. of Marshfield. The funds have been budgeted in 2008.
2. It was moved by Alderperson Olson, seconded by Alderperson Johnson to accept the low bid of $16,000.00 from Quality Roofing, Inc. Motion carried.
3.The BREMS February 2008 report was distributed including runs, budget, training, personnel and other business.
4. Police Chief Don Gilberg reviewed his February 2008 report including budget, case load, current events and personnel issues. He briefly explained the upgraded parking software.
5. The Committee reviewed the suggested ordinance changes Chief Gilberg presented at last months meeting. He will meet with City Attorney Dan Diehn to finalize the changes and bring the results to the next Council meeting.
6. Darren Durman, President of the Downtown Association, spoke on behalf of several downtown business owners regarding the problems with limited customer parking in the downtown area. Chief Gilberg will speak with the business owners that habitually violate the 2-hour parking ordinance. Raising the fine for parking tickets was also discussed.
7. The establishment of a Municipal Court was briefly discussed.
8. It was moved by Alderperson Olson, seconded by Alderperson Johnson to adjourn. Motion carried.

The Finance Committee met at City Hall in the City of Black River Falls on March 4, 2008 at 6:00 P.M. Alderpersons Eddy, Rahmlow, Danielson, Olson, and Austin were present.
- It was moved by Alderperson Rahmlow, seconded by Alderperson Austin to approve the February 2008 general fund vouchers in the amount of $2,118,011.34. Motion carried.
- It was moved by Alderperson Danielson, seconded by Alderperson Olson to approve the January 2008 City Treasurer’s report. Motion carried.
- It was moved by Alderperson Rahmlow, seconded by Alderperson Austin to approve the January 2008 revenues report. Motion carried.
- It was moved by Alderperson Olson, seconded by Alderperson Danielson to approve the January 2008 expenditures report. Motion carried.
- Mayor Hunter reported that the City’s health insurance premiums through the Central States Health and Welfare plan will not increase for the year ending March 28, 2009. The following year increase will be less than the original quotes resulting in a cost savings over the two-year period of approximately $75,000.00.
The Mayor also stressed the importance of the City having access to a human resources individual or firm in the future.

CITY OF BLACK RIVER FALLS ORDINANCE NO. 780
AN ORDINANCE FOR ANNEXATION OF PROPERTY FROM THE TOWN OF BROCKWAY TO THE CITY OF BLACK RIVER FALLS, JACKSON COUNTY, WISCONSIN, BY CITY COUNCIL RESOLUTION PURSUANT TO THE PROVISIONS OF WIS. STAT. SECTION 66.0223.
The Common Council of the City of Black River Falls, Jackson County, Wisconsin do ordain as follows:
SECTION 1. Legislative Findings.
WHEREAS, the City of Black River Falls, Jackson County, Wisconsin, at its meeting held on February 5, 2008 passed a resolution in lieu of petition for direct annexation, pursuant to the provisions of Wis. Stat. section 66.0223; and
WHEREAS, the City of Black River Falls Plan Commission considered the petition at its regularly scheduled meeting on February 5, 2008 and recommended annexation of the described property; and
WHEREAS, the territory to be annexed is currently within the Town of Brockway, Jackson County, Wisconsin, and the Town of Brockway was served with notice of the annexation petition; and
THEREFORE, it is found that the proper procedural requirements for annexation by resolution of the property described herein below have been met.
SECTION 2. Authority. Pursuant to the legislative findings hereinabove, the below described properties are annexed to the Third Ward of the City of Black River Falls, Jackson County, Wisconsin, pursuant to the provisions of Wis. Stat. section 66.0223.
SECTION 3. Description of Territory. The portion of the territory annexed from the Town of Brockway, Jackson County, Wisconsin, to the City of Black River Falls, Jackson County, Wisconsin, is described as follows:
The Northwest Quarter of the Northwest Quarter and the Southwest Quarter of the Northwest Quarter of Section Eighteen, Township Twenty-one North, Range Three West, subject to the following exceptions: that part of the 1909 Plat of Vaudriel which is located in the Northwest Quarter of said Section Eighteen. The platted street which lies on the East edge of said plat is a part of this exception: ALSO EXCEPTING Lot Three of Jackson County Certified Survey Map No. 1264; ALSO EXCEPTING the land included in deed recorded in Register of Deeds Office in Volume 379 on Page 576; ALSO excepting the land included in the road easement granted to the Town of Brockway on Document Number 267800 recorded in the Register of Deeds Office in Volume 326 on Page 730. (This is the town Road which runs approximately along the South line of the Southwest Quarter of the Northwest Quarter.)
SECTION 4. Temporary Zoning Classification. The annexed property is temporarily designated a I-Industrial District in accordance with Wis. Stat. Section 62.23 and the Zoning ordinance of the City of Black River Falls, Jackson County, Wisconsin.
SECTION 5. Severability. The provisions of this Ordinance shall be deemed severable and it is expressly declared that the Common Council would have passed the other provisions of this Ordinance irrespective of whether or not one or more provisions may be declared invalid and if any provisions of this Ordinance or the application thereof to any person or circumstances is held invalid, the remainder of this Ordinance and the application of such provisions to other persons or circumstances shall not be effected thereby.
SECTION 6. Conflicting Ordinances. Ordinances or parts of ordinances in conflict with the above Ordinance are hereby repealed.
SECTION 7. Effective Date. Upon passage and publication, this Ordinance shall take effect and be in force as provided by law.

It was moved by Alderperson Mathews, seconded by Alderperson Johnson to convene into closed session for the purpose of deliberation concerning a case which is the subject of a quasi-judicial hearing which is authorized under section 19.85(1)(a) of the Wisconsin Statutes. Motion carried.
