A special meeting of the Common Council was held at City Hall in the City of Black River Falls on April 15, 2014 at 6:25 P.M. Alderpersons R. Eddy, Hackman, Olson, J. Eddy, Gearing-Lancaster, Chojnacki, Johnson, and Pankowitz were present. Mayor Danielson presided.

There was discussion on the identifiers and legal liabilities related to the proposed Title VI Plan.

Alderperson J. Eddy opened discussion on the Municipal Utilities being under billed by WPPI for 9 months due to a faulty meter and how the Utilities plan to pay the amount owed. Alderperson R. Eddy provided all interested Alderpersons in attendance with a letter from WPPI explaining how the defective meter was discovered and how the amount owed was calculated.

OLD BUSINESS

City Attorney Dan Diehn explained differences between the original draft of Ordinance 817 Amending the Code of Black River Falls, Jackson County Wisconsin by Repealing and Recreating Section 12.02(4) Safety and Sanitation requirements and the revised version presented at this meeting. The Council believed the new language met the objectives of the Council and plan to move forward with the new language by bringing it back to the Committee of the Whole meeting on November 21, 2013.

NEW BUSINESS

City Administrator Brad Chown presented a proposal submitted by Street Superintendent Todd Gomer to add two part-time positions to the Street Department and eliminate the one vacant full-time position in this department. One part-time garbage laborer would be utilized 20 hours per week and one part-time recycling laborer would be utilized 32 hours every other week.

It was moved by Alderperson J. Eddy, seconded by Alderperson Johnson to approve two new part-time positions in the Street Department as presented. Motion Carried with Alderperson Herman Abstaining.

Special Common Council Meeting Minutes October 29, 2013

NEW BUSINESS

The proposed 2014 budget was discussed. Street Superintendent Todd gomer explained to the Council that his outlay items will be fine in 2014 with the proposed cuts, but may require some borrowing in 2015 to stay on track with the 5 year plan. A dump truck/plow truck was taken out of the 2014 outlay to allow repairs to West Adams Street.

It was moved by Alderperson Rahmlow, seconded by Alderperson Olson to approve the 2014 budget and tax levy for publication. Motion Carried.

Alderperson R. Eddy informed the Council that the Utility Commission is working on an employee handbook for utility employees, and he is not comfortable with some of the benefits being proposed for utility employees that are not included in the City’s handbook for city employees. Alderperson R. Eddy agrees in wage differences for different job descriptions, but feels benefits should be the same. The solution offered was to have Mayor Danielson, the City Administrator, and the Utility Manager meet and develop a handbook together. Another solution offered by the Council would be to eliminate the Utility Commission and have all decisions come to the Council so there is only one body making the decisions for all city employees. The City Administrator and the Mayor were tasked with researching the requirements and the impact to the City if this option were pursued.

COMMITTEE REPORTS

The Department Head monthly reports were reviewed. Department heads present were Tammy Peasley, Steve Peterson, Steve Schreiber, Jody Stoker, Todd Gomer, Dave Frederick and Brad Chown.

Street Superintendent, Todd Gomer, reported a couple of manholes are hidden in the BP area and that Paragon & Associates is doing surveying in the area.

Parks & Recreation Director, Steve Peterson, expressed concern on testing safety on water. Parks will be changing the fee structures on water parks. DHHS does inspections and their fees will be going up. Director Peterson had a meeting with other associations for scheduling practices for hockey and figure skating at the new arena. Swimming and wrestling programs will be changed. Mayor Danielson reported the Animal Barn will be opened up for storage.

Police Chief, Dave Frederick, is working on two requests for signs in the City.

Library Director, Tammy Peasley, will be including statistics on future reports.

Jim Hoffman presented information on a temporary concrete plant Hoffman Construction is interested in having. Bids will be due November 12, 2013 for the DOT I-94 project. The DNR and DOT will regulate dust and noise. The plant’s hours of operation would be 6:00 a.m. to 6:00 p.m. with occasional Saturdays. It is anticipated that 40-60 days would be needed for operating and no recycling would be done on this site. The plant would be on the Hoffman property April 2014 through November 2015. It was moved by Alderperson R. Eddy, seconded by Alderperson Chojnacki to allow Hoffman Construction to construct a temporary concrete batch plant on their property at the end of Depot Road. Motion Carried.

City Attorney, Daniel Diehn, explained the Housing Authority/Commission roles. This five member group would include two members of the City Council and the remaining three would be citizens of the community. We need a safe and sanitary program for low-income citizens. Alderperson Gearing-Lancaster confirmed the need in our community. Alderperson R. Eddy questioned if we have low-income housing in the City and if they are full. Fire Chief, Schreiber, stated there are living quarters above downtown businesses that are substandard. Alderperson Rahmlow questioned if funds are available and how much. Alderperson Gearing-Lancaster will bring information to the November meeting and Attorney Diehn will draft a resolution.

1.The Department Head monthly reports were reviewed. Department heads present were Muriel Gunderson, Steve Schreiber, Todd Gomer, Steve Peterson, Dave Frederick, and Brad Chown.

2.Library Director Muriel Gunderson thanked the Council for the opportunity to be the Library Director for the past six years and hopes the library continues to move forward. Mayor Danielson thanked Muriel for her service. Reception for Muriel September 26, 2013 from 2p-4p at the library.

3.Fire Chief Steve Schreiber advised the bids for the SCBA project came in lower than expected. He is looking in to applying the excess funds to the maintenance program for the equipment.

4.EMS Division Chief Jody Stoker was out of town at training. Chief Schreiber advised they have had some heating/cooling issues with the new remodel but adjustments are being made.

5.Street Superintendent Todd Gomer advised a sink hole at N. First St. and Main St. appears to be a matter of ground settling over the years since work was last done in this area in 1984. Another sink hole at Alder St. and Gordon St. was due to a broken pipe. The Street Dept. has had several similar problems in this area in the past and have the pipe repaired as of today.

6.Police Chief Dave Frederick had nothing further to report. Alderperson Chojnacki requested follow up on complaints of taxi drivers smoking in the taxi. Chief Frederick advised the department has been in contact with Rick Bauer and citations will be issued if complaints are received in the future. Alderperson Johnson asked for clarification on reimbursing an officer for ammunition. Chief Frederick advised the officer reimbursed the City for ammunition. Alderperson Johnson asked for clarification on the purchase of wallet badges. Chief Frederick advised these items were issued to officers and remain the property of the city and were purchased because the department did not have them in the past.

7.Parks & Recreation Director Steve Peterson had nothing further to report. Mayor Danielson advised winter storage at the fairgrounds will begin on October 19, 2013 from 8:00am to noon and asked for volunteers to assist with the process.

8.Alderperson R. Eddy reminded the City Administrator of the Council’s wishes to have pedestrian lights for the intersection of Highway 12/27 at Highway 54 in the 2014 Street Department budget.

9.It was moved by Alderperson Johnson, seconded by Alderperson Herman to approve Amendment #3 to the Employee Handbook (3rd Reading) adding the Organizational Chart to Section I of the handbook. Motion carried.

10.The Council discussed the reactivation of the City’s Housing Authority. One of the main purposes for the reactivation would be to address transitional housing needs. Peggy Holmgreen, citizen in attendance, advised there are grant dollars available for these types of projects, but a Housing Authority needs to be in place to apply. Muriel Gunderson expressed concern about allowing this type of housing in to residential districts in the city. It was moved by Alderperson Chojnacki, seconded by Alderperson Johnson to have the City Attorney and the City Administrator research reactivation of the City’s Housing Authority and provide the Council with information at the October Common Council meeting or the October Committee of the Whole meeting. Motion Carried.

11.It was moved by Alderperson R. Eddy, seconded by Alderperson Herman to approve the August 2013 vouchers in the amount of $313,406.91. Motion carried.

NEW BUSINESS

Ordinance 817 Amending the Code of Black River Falls, Jackson County, Wisconsin by Repealing and Recreating Section 12.02(4) Safety and Sanitation Requirements was read (1st Reading). Mayor Danielson advised those who wished to speak would be limited to five minutes each to allow time for all to be heard. Dan Huebner, Building Inspector with General Engineering, Fire Chief Steve Schreiber, and Police Chief Dave Frederick were in attendance along with 12 citizens and business owners. Concerns expressed by citizens/business owners in attendance included having additional inspections, only one other town in Wisconsin has these inspections tied to the liquor license, more paperwork, current health inspection back log, those leasing a building may have difficulty getting building owner to make needed corrections, the vague language on if/\when the City would withhold a license, and the redundancy of the inspectors having the authority to close a business for violations and giving the City the same authority. It was explained that the required inspections would be those already required of these businesses with no additional paperwork or inspections and examples were given of other towns in the state that tie these inspections to liquor license renewal. The Council will look at different language to firm up when the Council might act on inspections. Randy Molini, owner of Rozario’s, expressed his concern with the Council targeting specific businesses and his concern that having the Fire Chief and the Police Chief inspecting at the same time seemed heavy handed toward the business owner. Mr. Molini distributed a resolution to the members of the Council.

The City Administrator presented the proposed 2014 budget. The proposed increase in operating expenditures exceeds the limits set by the State under the expenditure restraint program which would compromise the amount of state aid the City would be eligible for. The tax levy increase that would be required to cover the increase in expenditures would also exceed the levy limit imposed by the State. The City Administrator will work with the department heads to reduce department budgets and present a revised budget at the Committee of the Whole meeting October 23, 2013.

It was moved by Alderperson Johnson, seconded by Alderperson Herman to adjourn in to closed session as authorized under Section 19.85(1)(f) of the Wisconsin Statutes. Motion carried.
