The regular meeting of the Common Council was held at City Hall in the City of Black River Falls on November 5, 2014 at 6:00 P.M. Alderpersons R. Eddy, Olson, J. Eddy, Gearing-Lancaster, Chojnacki, Johnson and Erickson were present. Mayor Danielson presided.

It was moved by Alderperson Olson, seconded by Alderperson R. Eddy to appoint Brad Rahmlow to replace Amber Hackman as First Ward Alderperson for the balance of the term. Motion carried.

Special Common Council Meeting Minutes September 17, 2014

A special meeting of the Common Council was held at City Hall in the City of Black River Falls on September 17, 2014 at 6:00 P.M. Alderpersons R. Eddy, Hackman, Olson, J. Eddy, Gearing-Lancaster, Chojnacki, Johnson, and Pankowitz were present. Mayor Danielson presided.

CITIZENS IN ATTENDANCE: 61 citizens in attendance. No new items were brought up for discussion - all were present for other items already on the agenda.

The Council discussed changing Pierce Street (West of S. 11th Street) from one-way to two-way. Officer Tom Cooper stated there would not be any safety issues. City Attorney Dan Diehn will research the procedures for making the change and draft the required documents.

Common Council Meeting Minutes of July 23, 2014

A special meeting of the Common Council was held at City Hall in the City of Black River Falls on July 23, 2014 at 6:00 P.M. Alderpersons R. Eddy, Hackman, Olson, J. Eddy, Gearing-Lancaster, Chojnacki, Johnson, and Pankowitz were present. Mayor Danielson presided.

It was moved by Alderperson Johnson, seconded by Alderperson Chojnacki to dispense with the reading of the minutes of the July 1, 2014 Common Council meeting. Motion carried.

It was moved by Alderperson J. Eddy, seconded by Alderperson Chojnacki to approve the Temporary Beer License and a draft of a new map showing detail for beer sales locations for the Jackson County Ag Society for the Jackson County Fair to be held July 30 – August 3, 2014. Motion carried (7-0-1) with Alderperson Hackman abstaining since the final map was not available at the time of voting. Fair Board President Roger Castle presented the final map later at the meeting.

Bill and Kathy Potter were present to discuss undeveloped property compliance with the Noxious Weed Ordinance. Bill would like the ordinance revised stating that only property with curb and gutter should be mowed approximately 5 – 6 feet from curb line and around fire hydrants. Bill also stated concern with homes not being kept up in the City. He feels if vacant lots need to be mowed, homes should need to be cleaned up as well. Mayor Danielson stated the matter would be referred to the City Attorney to draw up a revision to the Noxious Weed Ordinance.

It was moved by Alderperson Johnson, seconded by Alderperson Gearing-Lancaster to place on file the Contract Negotiation Committee minutes of July 1, 2014 and the Policy Committee minutes of July 9, 2014. Motion carried.

The Department Head monthly reports were reviewed. Department heads present were Steve Schreiber, Jody Stoker, Todd Gomer, Dave Frederick, Steve Peterson, Brad Chown and Tammy Peasley.

1.Frank Koresh and Melissa Windsor have accepted full time EMT positions starting in mid-August.

2.It was moved by Alderperson Johnson, seconded by Alderperson Hackman to approve the EMS request to sell their 2004 ambulance on sealed bids. Motion carried.

3.Street Superintendent Todd Gomer advised the Council there are major storm water drainage problems at the intersection of 11th Street and Van Buren Street. The water runs down Van Buren to 11th and diverts south of Van Buren at an angle to the intersection of 10th and Harrison Street causing back yard flooding to residential homes. There was lengthy discussion on this issue trying to determine the most effective and efficient way to handle this. Superintendent Todd Gomer presented a proposal to install a storm water sewer system on Van Buren between 11th Street and 12th Street, and he estimated the project would cost approximately $100,000 if he did the storm water sewer work and contracted for the street paving. This project could be completed in 2016 with funds that are budgeted which would eliminate having to borrow money for the project if he does not complete all other street projects that he had planned for 2016.

4.It was moved by Alderperson R. Eddy, seconded by Alderperson Pankowitz to hire S.E.H. to conduct a preliminary Storm Water Drainage Study on Van Buren Street and golf course area with the cost to be expended out of the contingency fund. Motion carried.

5.Street Superintendent Todd Gomer advised the Council that Jerry Martel from Sparta will have figures for the recycling plan by July 28th. Jerry would pick up recycling by wards like the City does now. He will be present at the Committee of the Whole meeting in August for discussion.

6.Police Chief Frederick was present to give his report. Chief Frederick supplied the Council with details of the Black River Falls Police Department Qualification Course and a lengthy discussion followed. There was mention of two police officers being placed on administrative leave because they failed the new firearms qualifying course being implemented by the State. Mayor Danielson later issued a letter taking the two officers off of administrative leave, placing them back on duty, and suspending firearms qualifying. Alderperson Hackman expressed concern that this act was illegal and presented a huge liability for the City. Alderperson Pankowitz agreed that if an officer could not qualify, then that officer should not be on the street or at least should not be allowed to carry a firearm until that officer can qualify. Mayor Danielson reassured the Council of the laws and stated that the City’s labor law attorney and the City Attorney were consulted before reinstating the two officers. It is the Mayor’s understanding that the officers both qualified with their firearms last year under the department’s requirements and have until June 30, 2015 to be in compliance with the new state requirements. Alderperson R. Eddy suggested we consider sending officers outside the department for this training and qualifying and questioned why an officer would still be on the force if that officer had trouble passing previously and has an attitude not to train.

7.It was moved by Alderperson Hackman, seconded by Alderperson Pankowitz to put the two officers who failed the state course on administrative leave until they train and pass and firearms qualifying resume. Motion denied (2-6) with Alderpersons R. Eddy, Olson, J. Eddy, Gearing-Lancaster, Chojnacki and Johnson voting no.

8.Alderperson Johnson commended Officer Noack and Officer Thesing for their duties at Riverfest in La Crosse, WI. Chief Frederick stated the officers help out quite often at these events representing the City of Black River Falls.

9.Chief Frederick advised the Council that the speed trailer is repaired and will be back out on the streets soon.

10.Director of Parks and Recreation Steve Peterson presented his monthly report. Setting up for the Fair starts this week.

11.Library Director Tammy Peasley thanked Parks and Recreation for mowing the lawn between City Hall and the Library and for taking down a tree. Tammy and her staff are busy doing projects in-house removing wallpaper and painting to give a new visual interest. Grant funding is in the works.

12.Fire Chief Schreiber presented his monthly report with no additional changes.

Common Council Minutes of June 3, 2014

Mayor Danielson gave information about the Peace Pole project that the Black River Falls High School Student Senate would like to do. They were to present the project, but nobody was in attendance so they will need to come back to another meeting to present and move forward with this project.

1.Alderperson Hackman asked Fire Chief Schreiber what kind of counseling is in place for firefighters when they encounter a death. Chief Schreiber said the City doesn’t have an Employee Assistance Program (EAP) in place; however, the Fire Department takes care of it by using Gundersen Lutheran when needed. Alderperson Chojnacki asked for the situation of the fatal crash in the Chief’s report, and Chief Schreiber advised that information would be available by requesting the accident report from the Sheriff’s Department.
