The regular meeting of the Common Council was held at City Hall in the City of Black River Falls on December 6, 2011 at 6:00 P.M. Alderpersons Olson, J. Eddy, Gearing-Lancaster, Chojnacki, Johnson, Herman, R. Eddy and Rahmlow were present. Mayor Danielson presided.

Black River Emergency Medical Service Division Chief Brad Chown was in attendance to support the proposed by-law change explained in his November 2011 department report. The change refers to hours of call shifts required per EMT per month.

Ordinance #804, AN ORDINANCE REPEALING AND RECREATING SECTIONS 10.03(8) AND 10.08 OF THE CITY OF BLACK RIVER FALLS BY REGULATING WEED CONTROL was presented for the 2nd reading. After considerable discussion the ordinance was tabled until the January 3, 2012 Council meeting. The ad hoc weed committee will meet for review of the ordinance on December 21, 2012 at 5:00 P.M.

The Common Council of the City of Black River Falls do ordain as follows:

SECTION 4. Conflicting Ordinances. Ordinances or parts of ordinances in conflict with the above ordinance are hereby repealed.

CITY OF BLACK RIVER FALLS ORDINANCE NO. 806
AN ORDINANCE CREATING SECTION 9.095 OF THE CODE OF ORDINANCES OF THE CITY OF BLACK RIVER FALLS, JACKSON COUNTY, WISCONSIN
PROHIBITING PUBLIC URINATION AND DEFECATION
The Common Council of the City of Black River Falls, Jackson County, Wisconsin do ordain as follows:
SECTION 1. Public Urination and Defecation Prohibited. Section 9.095 of the Code of Ordinances of the City of Black River Falls is hereby recreated to read as follows:
Section 9.095 PUBLIC DEFECATION AND URINATION PROHIBITED. No person shall defecate or urinate outside of designed sanitary facilities, upon any sidewalk, street, alley, public parking lot, park, playground, cemetery or other public areas within the City of Black River Falls, or upon any public or private property in open view of the public, or in the halls or rooms without designed sanitary facilities, stairways or elevators of public or private commercial buildings.
- Penalties. Any person who violates this ordinance shall be subject to the penalty as set
forth in Section 25.04 of this Code of Ordinances.
SECTION 2. Severability. The provisions of this Ordinance shall be deemed severable and it is expressly declared that the Common Council would have passed the other provisions of this Ordinance irrespective of whether or not one or more provisions may be declared invalid and if any provisions of this Ordinance of the application thereof to any person or circumstances is held invalid, the remainder of this Ordinance and the application of such provisions to other persons or circumstances shall not be affected thereby.
