Common Council Minutes of November 1, 2011

The regular meeting of the Common Council was held at City Hall in the City of Black River Falls on November 1, 2011 at 6:00 P.M.  Alderpersons Olson, J. Eddy, Gearing-Lancaster, Chojnacki, Johnson, Herman, R. Eddy and Rahmlow were present.  Mayor Danielson presided.

It was moved by Alderperson Johnson, seconded by Alderperson Chojnacki to dispense with the reading of the minutes of the October 4, 2011 Council meeting.  Motion carried.

COMMITTEE REPORTS

It was moved by Alderperson R. Eddy, seconded by Alderperson Johnson to approve the Committee of the Whole minutes of October 19, 2011.  Motion carried.

The Committee of the Whole met at City Hall in the City of Black River Falls on             October 19, 2011 at 6:00 P.M.  Alderpersons Olson, J. Eddy, Gearing-Lancaster, Chojnacki, Johnson, Herman, R. Eddy and Rahmlow were present. Mayor Danielson presided.

  1. The Department Heads presented their monthly reports.
  2. Police Chief Dave Frederick reviewed the recently adopted concealed carry law as it relates to municipal buildings.
  3.  It was moved by Alderperson Rahmlow, seconded by Alderperson Johnson to approve the September 2011 vouchers in the amount of $423,458.70.  Motion carried.
  4. It was moved by Alderperson Chojnacki, seconded by Alderperson Olson to approve the September 2011 City Treasurer’s report.  Motion carried. 
  5. It was moved by Alderperson Johnson, seconded by Alderperson Gearing-Lancaster to approve the September 2011 Revenue and Expense report. Motion carried.
  6. City Administrator Bill Arndt advised the Council of several adjustments he had made to the proposed 2012 City Budget.  The adjustments reduced the proposed 2012 City Tax Levy by $11,932.  He recommended the City publish the proposal 2012 City Budget with City Tax Levy of $1,759,579. 
  7. It was moved by Alderperson Chojnacki, seconded by Alderperson Gearing-Lancaster to set a public hearing on the proposed budget as above for 6:00 pm, November 16, 2011.  Motion carried.
  8. It was moved by Alderperson Gearing-Lancaster, seconded by Alderperson Johnson to adopt the Title VI Plan, which prohibits discrimination by the City, as presented.  Motion carried.
  9. It was moved by Alderperson Johnson, seconded by Alderperson Olson to adopt the Limited English Proficiency Plan for the City as presented.  Motion carried.
  10.  It was moved by Alderperson Chojnacki, seconded by Alderperson Johnson to adjourn.  Motion carried.

It was moved by Alderperson Johnson, seconded by Alderperson J. Eddy to place on file the Library Board minutes of September 27, 2011.  Motion carried.

NEW BUSINESS

Roy Malin advised the Council that he is in negotiations to purchase the Cozy Corner tavern including the building.  He reviewed his background and answered questions from the Council.

It was moved by Alderperson R. Eddy, seconded by Alderperson Olson to approve the Class B beer and liquor license as submitted by RRTC, LLC (Roy Malin sole member) for 43 Main Street (Cozy Corner) as published and contingent on the surrender of the current license for that location.  Motion carried.

Ordinance #804, AN ORDINANCE REPEALING AND RECREATING SECTIONS 10.03(8) AND 10.08 OF THE CITY OF BLACK RIVER FALLS BY REGULATING WEED CONTROL was presented for the 1st reading.

Ordinance #805, AN ORDINANCE REPEALING AND RECREATING SECTION 9.01 OF THE CODE OF ORDINANCES OF THE CITY OF BLACK RIVER FALLS, JACKSON COUNTY, WISCONSIN was presented for the 1st reading.

Ordinance #806, AN ORDINANCE CREATING SECTION 9.095 OF THE CODE OF ORDINANCES OF THE CITY OF BLACK RIVER FALLS, JACKSON COUNTY, WISCONSIN PROHIBITING PUBLIC URINATION AND DEFECATION was presented for the 1st reading.

It was moved by Alderperson Olson, seconded by Alderperson Chojnacki to approve a special beer license for the Black River Falls Downtown Association for North 2nd Street for December 3 and 4, 2011.  Motion carried.
