Common Council Minutes of January 5, 2010

The regular meeting of the Common Council was held at City Hall in the City of Black River Falls on January 5, 2010 at 6:00 P.M.  Alderpersons Johnson, Mathews, R. Eddy, Rahmlow, Olson, J. Eddy, Onstad and Gearing-Lancaster were present. Mayor Danielson presided.

It was moved by Alderperson R. Eddy, seconded by Alderperson Rahmlow to dispense with the reading of the minutes of the December 1, 2009 Council meeting.  Motion carried.

COMMITTEE REPORTS

 

It was moved by Alderperson R. Eddy, seconded by Alderperson Gearing-Lancaster to approve the Committee of the Whole minutes of December 16, 2009. Motion carried.

The Committee of the Whole met at City Hall in the City of Black River Falls on December 16, 2009 at 6:00 P.M.  Alderpersons Johnson, Mathews, R. Eddy, Rahmlow, Olson, J. Eddy, Onstad, and Gearing-Lancaster were present. 

 

  1. Attorney Bill Poss with the public defender’s office and Jackson County District Attorney Gerald Fox advised the Committee of the history and current status of the Jackson County Treatment Court. They requested that City Police Officers assist with the breathalyzer testing of the treatment court participants that live within the City. There are currently four participants living within the City. They request one random test per participant per week.

It was moved by Alderperson Mathews, seconded by Alderperson Rahmlow to authorize the City Police Department to participate in the drug court testing as above for a six month trial period with Chief Gilberg reporting back to the Committee at that time as to the number of tests given, expense incurred and any other information pertinent to the trial period. Motion carried.

  5. It was moved by Alderperson Johnson, seconded by Alderperson R. Eddy to authorize Street Superintendent Todd Gomer to advertise for bids for a leaf collector and pick-up which are included in the 2010 budget. Motion carried.

  7. It was moved by Alderperson Mathews, seconded by Alderperson Gearing-Lancaster to authorize purchase of seven portable radios through an Office of Justice Assistance grant of $6,209.00. The City share of $2,065.00 will be taken from the license plate fund. Motion carried.

 

  • The proposed No Smoking ordinance was presented to and discussed by the Committee. The ordinance prohibits smoking in any City buildings or vehicles. The ordinance will be on the agenda for the January 2010 Council meeting.

  • It was moved by Alderperson J. Eddy, seconded by Alderperson Onstad to approve the November 2009 vouchers in the amount of $ 1,204,415.24. Motion carried.

  • It was moved by Alderperson Rahmlow, seconded by Alderperson R. Eddy to approve the November 2009 Treasurer’s report.  Motion carried.

  • It was moved by Alderperson Onstad, seconded by Alderperson Olson to approve the November 2009 revenue and expense reports.  Motion carried.

  • It was moved by Alderperson Olson, seconded by Alderperson J. Eddy to adjourn.  Motion carried.

      It was moved by Alderperson Mathews, seconded by Alderperson Johnson to place on file the Library Board minutes of November 24 and December 14, 2009. Motion carried.

      It was moved by Alderperson Rahmlow, seconded by Alderperson Olson to place on file the Utility Commission report of November 30, 2009. Motion carried.

      NEW BUSINESS

       

      Ordinance #794, AN ORDINANCE PROHIBITING SMOKING IN CITY BUILDINGS AND VEHICLES was distributed.

      It was moved by Alderperson Olson, seconded by Alderperson Johnson to adopt Ordinance #794. Motion carried.

      City Attorney Dan Diehn reviewed the history and status of the City financing of the Lallapalooza Estates subdivision. The City borrowed funds for the improvements to the property on behalf of J and B Haldeman Holdings, LLC and set up special assessments to be paid back to the City over a 10-year period. Since the lots are not selling as quickly as anticipated, the Haldemans are requesting an extension of the pay back period.

      It was moved by Alderperson Mathews, seconded by Alderperson Johnson to authorize Mayor Danielson, City Attorney Dan Diehn and City Administrator Bill Arndt to approve an amendment to the current development agreement which is in substantial compliance with the new terms and condition contained in the December 28, 2009 memo from the Mayor and Administrator to the Alderpersons. Motion carried with Alderperson J. Eddy voting no.
