Common Council Minutes of February 2, 2010

The regular meeting of the Common Council was held at City Hall in the City of Black River Falls on February 2, 2010 at 6:00 P.M.  Alderpersons Johnson, Mathews, R. Eddy, Rahmlow, Olson, J. Eddy, Onstad and Gearing-Lancaster were present. Mayor Danielson presided.

It was moved by Alderperson R. Eddy, seconded by Alderperson Olson to dispense with the reading of the minutes of the January 5, 2010 Council meeting.  Motion carried.

COMMITTEE REPORTS

It was moved by Alderperson R. Eddy, seconded by Alderperson Rahmlow to approve the Committee of the Whole minutes of January 20, 2010. Motion carried.

The Committee of the Whole met at City Hall in the City of Black River Falls on January 20, 2010 at 6:00 P.M.  Alderpersons Johnson, Mathews, R. Eddy, Rahmlow, Olson, J. Eddy, Onstad, and Gearing-Lancaster were present.

 

  1. The Department Heads presented their January 2010 monthly reports.

 

Parks and Recreation Director Steve Peterson presented a list of programs his department is sponsoring. The City will also set up a special revenue fund for the Spaulding Road Community Garden.

 

  1. It was moved by Alderperson R. Eddy, seconded by Alderperson Olson to authorize Police Chief Don Gilberg to advertise for bids to replace the 2006 Durango. Funds are included in the 2010 budget. Motion carried.
  2. It was moved by Alderperson Mathews, seconded by Alderperson Johnson to approve the 2010 Fire Department officers as follows:

3rd Assistant Chief                              John Jessop

1st Captain                                           Mike Muth

2nd Captain                                          Jody Stoker

Motion carried.

 

  1. It was moved by Alderperson Rahmlow, seconded by Alderperson R. Eddy to approve the December 2009 vouchers in the amount of $ 551,229.54. Motion carried.
  2. It was moved by Alderperson Olson, seconded by Alderperson J. Eddy to adjourn.  Motion carried.

OLD BUSINESS

Ordinance #794, AN ORDINANCE PROHIBITING SMOKING IN CITY BUILDINGS AND VEHICLES was distributed as the 2nd reading.

It was moved by Alderperson Mathews, seconded by Alderperson Johnson to adopt Ordinance #794. Motion carried.

CITY OF BLACK RIVER FALLS ORDINANCE NO. 794

 

AN ORDINANCE CREATING SECTION 1.07 OF THE CODE OF ORDINANCES OF THE CITY OF BLACK RIVER FALLS, JACKSON COUNTY, WISCONSIN, PROHIBITING SMOKING PURSUANT TO THE PROVISIONS OF §101.123 OF THE WISCONSIN STATUTES, CLEAN INDOOR AIR ACT.

The Common Council of the City of Black River Falls, Jackson County, Wisconsin do ordain as follows:

SECTION 1. Section 1.07 of the Code of Ordinances of the City of Black River Falls, is created as follows:

  1. (1) Definitions. “Smoking” and “Smoke” means to carry a lighted cigar, cigarette, pipe or any other lighted smoking equipment.

(2)        Regulation of Smoking in Indoor Areas of Buildings Owned, Rented or Leased by the City. Pursuant to the provisions of §101.123 of the Wisconsin Statutes, as amended, no person may smoke at any time within any enclosed indoor area of a building owned, rented or leased by the City of Black River Falls.

(3)        Regulation of Smoking in Vehicles Owned, Rented or Leased by the City. Pursuant to the authority of §66.01 of the Wisconsin Statutes, no person may smoke at any time within any vehicle which is owned, rented or leased by the City.

(4)        Enforcement and Penalty. Any person who violates this Ordinance after being advised by an employee of the City that smoking is prohibited in or at that location shall forfeit One-hundred Dollars ($100.00) plus the costs of prosecution, and in default of payment of such forfeiture and costs, shall be imprisoned in the County Jail until payment thereof, but not exceeding thirty (30) days.

 

SECTION 2.  Severability. The provisions of this Ordinance shall be deemed

severable and it is expressly declared that the Common Council would have passed the other provisions of this Ordinance irrespective of whether or not one or more provisions may be declared invalid, the remainder of this Ordinance and the application of such provisions to other persons or circumstances shall not be affected thereby.

SECTION 3.  Conflicting Ordinances. Ordinances or parts of ordinances in

conflict with the above Ordinance are hereby repealed.

 

SECTION 4.  Effective Date. Upon passage and publication, this Ordinance shall

take effect and be in force as provided by law.

NEW BUSINESS

The Council reviewed a January 28, 2010 memo concerning the Pines nuisance abatement. After DNR well inspection this spring, the remaining debris will be removed from the site, the basements filled in, the septic tanks pumped and filled and the north boundary will be fenced at the access points. The City’s Building Inspector will then make a final determination as to the condition of the property.

Resolution 2010-1, A RESOLUTION TO ESTABLISH A $1,000,000 LINE OF CREDIT FOR A 1 YEAR PERIOD FOR DAM RECONSTRUCTION was distributed.

It was moved by Alderperson R. Eddy, seconded by Alderperson Mathews to adopt Resolution 2010-1. Motion carried.
