The regular meeting of the Common Council was held at City Hall in the City of Black River Falls on January 3, 2012 at 6:00 P.M. Alderpersons Olson, J. Eddy, Gearing-Lancaster, Chojnacki, Johnson, Herman, R. Eddy and Rahmlow were present. Mayor Danielson presided.

It was moved by Alderperson Gearing-Lancaster, seconded by Alderperson Chojnacki to dispense with the reading of the minutes of the December 6, 2011 Council meeting. Motion carried.

Lyall White represented the Black River Falls Downtown Association to request that the Council approve their proposal to look into the possibility of placing a roof over the city parking lot at North Second Street at Harrison Street. The roof would be high enough to allow parking. The shelter would be available to accommodate many different types of events throughout the year. The Council had no objections to the Association’s request.

COMMITTEE REPORTS
It was moved by Alderperson Johnson, seconded by Alderperson Herman to approve the Committee of the Whole minutes of December 21, 2011. Motion carried.
It was moved by Alderperson Rahmlow, seconded by Alderperson Johnson to place on file the Library Board minutes of December 20, 2011. Motion carried.

The Committee of the Whole met at City Hall in the City of Black River Falls on December 21, 2011 at 6:00 P.M. Alderpersons Olson, J. Eddy, Gearing-Lancaster, Chojnacki, Johnson, Herman, R. Eddy and Rahmlow were present. Mayor Danielson presided.
- The Department Heads presented their monthly reports.
- Alderperson Johnson reported on the earlier meeting of the Ad Hoc weed committee. They agreed with the changes made to the “enforcement” section after the last meeting, but decided to remove the 25% exception for growth in excess of the acceptable standards in Section 1 of the ordinance. The changes will be brought to the January 3, 2012 Council meeting.
- It was moved by Alderperson Rahmlow, seconded by Alderperson Herman to approve the November 2011 vouchers in the amount of $208,457.96. Motion carried.
- It was moved by Alderperson R. Eddy, seconded by Alderperson Chojnacki to approve the November 2011 City Treasurer’s report. Motion carried.
- It was moved by Alderperson Olson, seconded by Alderperson Gearing-Lancaster to approve the November 2011 Revenue and Expense report. Motion carried.

OLD BUSINESS
Ordinance #804, AN ORDINANCE REPEALING AND RECREATING SECTIONS 10.03(8) AND 10.08 OF THE CITY OF BLACK RIVER FALLS BY REGULATING WEED CONTROL was presented. The ordinance has been distributed for two readings previous to this meeting.
CITY OF BLACK RIVER FALLS ORDINANCE NO. 804
AN ORDINANCE REPEALING AND RECREATING SECTIONS 10.03(8) and 10.08 OF THE CITY OF BLACK RIVER FALLS BY
REGULATING WEED CONTROL
The Common Council of the City of Black River Falls, Jackson County, Wisconsin, do ordain as follows:
SECTION 1. Section 10.03(8) of the Code of Ordinances is Repealed and Recreated. On the effective date of this ordinance, Section 10.08 of the Code of Ordinances shall be repealed and recreated as follows:
10.03(8) NOXIOUS WEEDS. All noxious weeds, as defined in §66.0407(1),
Wis. Stats. In addition, other rank growth of vegetation, and all weeds,
grasses and plants over 8 inches in height, excluding trees and shrubs, which:
(a) Detract from the surrounding area and properties.
(b) Become a possible fire hazard, as determined by the Fire Chief.
(c) Become a health hazard due to their pollen or a potential cover
for disease-carrying rodents and other small animals.
(d) Are of infectious or poisonous nature in or adjacent to a populated area,
regardless of height.
(e) Become a potential hazard to vehicular traffic in vision clearance triangles.”
SECTION 2. Section 10.08 of the Code of Ordinances is Repealed and Recreated as follows:
“10.08 Weed Control. (1) NOXIOUS WEEDS AND RANK GROWTH PROHIBITED. No owner or occupant of any lot or parcel shall allow such property to become overgrown with any weeds or grass so as to constitute a public nuisance, as defined in sec. 10.03(8) of this chapter.
(2) ENFORCEMENT. If a property owner or occupant fails to control the growth of such weeds, grass or rank growth of vegetation on the property, the City of Black River Falls Police Department, Mayor or City Administrator shall send a written notice by First Class Mail to the owner’s address as shown on the City’s tax roll. If such owner fails to abate this nuisance within ten (10) days after the date the notice is mailed, the City of Black River Falls Police Department is authorized to issue a citation to the property owner, occupant, or any person with legally recognized management authority of the property and/or the City may abate the nuisance by removing or mowing the offending vegetation.
Following the first ten (10) days’ notice in any calendar year, the City may proceed with enforcement of future violations without sending a subsequent ten (10) day notice.
(3) ABATEMENT. If the City abates the nuisance as set forth above, all costs of abatement shall be added to the City tax rolls.
(4) APPLICABILITY. The responsibilities of landowners or occupiers under this section shall apply to the lot owned or occupied and to the public right-of-way lying between the property line and the roadway.
(5) EXCEPTION.
Properties owned by the City of Black River Falls are exempt from this Ordinance.
(6) PENALTY. In addition to the penalties provided in this chapter, any person who shall violate any provision of this chapter, or permit or cause a public nuisance, shall be subject to a penalty as provided in sec. 25.04 of this Code.
SECTION 3. Severability. The provisions of this Ordinance shall be deemed severable and it is expressly declared that the Common Council would have passed the other provisions of this Ordinance irrespective of whether or not one or more provisions may be declared invalid and if any provisions of this Ordinance or the application thereof to any person or circumstances is held invalid, the remainder of the Ordinance and the application of such provisions to other persons or circumstances shall not be effected thereby.
SECTION 4. Conflicting Ordinances. Ordinances or parts of Ordinances in conflict with the above ordinance are hereby repealed.
SECTION 5. Effective Date. Upon passage and publication, this Ordinance shall take effect and be in force as provided by law.
